  • The inability of the User to access the Platform due to reasons not attributable to the Company, the Platform, or other associated individuals, including representatives, agents, and employees thereof.
  • Any other matters concerning the Platform's operation that the User may encounter while utilizing the Platform to make purchases.
  • The User acknowledges and comprehends that the Platform is not responsible for any problems, including instances of loss of accessibility to the Platform, and any resulting outcomes or losses.
  1. TERMINATION:
    • The Company/Platform reserves the exclusive right to unilaterally terminate the User's account immediately in the following circumstances:
  • Discovery of the User engaging in activities that contravene the Terms of Use, Privacy Policy, and other related policies, the prevailing laws, or any regulations set forth by governing authorities.
  • Continuation of such activities despite prior notice.
  • Attempts to manipulate, exploit, distort, or misinterpret the Terms of Service, Privacy Policy, and other relevant policies, as well as applicable laws and regulations, with the intention of engaging in illicit activities.
  • Engagement in harassment, intimidation, provocation, abuse, harm, or any unlawful actions against Enteuxis, the platform, and any associated individuals, representatives, agents, and employees.
    • The User may opt to cancel their account only if they have not:
  • Uploaded, created, or distributed malicious software, content, viruses, or destructive algorithms that may harm the Company, the Platform, or any other involved individual or third party.
  • Violated any provisions of the Terms of Service, Privacy Policy, or similar policies, applicable laws, or regulations established by governing authorities.
    • Upon account termination, the Platform/Company shall deny access to the information and erase it within 90 days from all storage servers and personalized hardware utilized for the Platform's operation.
  1. MODIFICATIONS AND AMENDMENTS:
    • Enteuxis retains the right to enhance and modify the Enteuxis Service. Amendments to these terms and conditions will be communicated to the End User at least 90 days in advance if they pertain to changes in the Enteuxis Service, its business model, or its provision, or if necessitated by alterations in legal obligations or other applicable regulations. Continued use of the Enteuxis Service implies the End User's acceptance of the updated terms and conditions.
  2. GOVERNING LAW:
    • This Agreement is governed by the laws of the United States and is subject to the jurisdiction of the courts of __________, United States.
  3. Dispute Resolution:

    • The arbitration proceedings will be conducted in English.

    • Unless otherwise specified in the award, both parties shall equally bear the arbitration costs, including arbitrator fees.
    • Awards and proceedings shall adhere to the provisions of the relevant act.
    • The jointly issued Award by the Arbitrators will be deemed final.

    • In the event of any updates to the terms and conditions, Users will receive a notification through the app and portal, and their consent will be documented.
